Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the AI Search API, the developer API served at api.aisearchapi.dev, the dashboard and websites at aisearchapi.dev, and the related documentation and tooling (together, the “Service”). The Service is operated by AI Search API (aisearchapi.dev), a service of Cancode (“we”, “us”, or “our”).

By creating an account, generating an API key, or otherwise using the Service, you agree to these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.

1. What the Service does

The Service captures what real consumer AI surfaces, such as ChatGPT, Claude, Perplexity, Gemini, Copilot, and Google AI Overview/AI Mode, return for a given query, and returns the answer, with its citations inline, together with provenance describing how it was obtained, as a stable, versioned JSON Envelope. Every capture retains the verbatim upstream response internally.

Captures are performed by our own browser fleet using accounts and infrastructure that we control. The Service is a measurement instrument: it records what a surface returned at a point in time. We do not guarantee that any surface will return a particular result, be available, or continue to behave the same way over time.

2. Accounts and API keys

• You must provide accurate account information (including a valid email address) and keep it current.
• You are responsible for all activity under your account and API keys. Keep your API keys secret; treat them like passwords. Notify us promptly at legal@aisearchapi.dev if you believe a key has been compromised.
• You must be at least the age of majority in your jurisdiction, and you may not use the Service if we have previously terminated your account or if applicable law prohibits it.

3. Plans, usage metering, and payment

Use of the Service is metered. Captures and API calls consume credits or count against the quotas of your plan. We measure usage on our systems, and those measurements are authoritative for billing and rate-limiting purposes.

Where paid plans are offered, payments are processed by our payment processor (Stripe). Fees are charged in advance for the applicable period or on a usage basis as described at checkout, are non-refundable except where required by law or expressly stated, and are exclusive of taxes, which you are responsible for. We may change pricing prospectively; changes will not affect the period you have already paid for.

4. Acceptable use

You agree that you will not, and will not permit anyone to:

• Use the Service to capture, access, or attempt to access private, logged-in, or otherwise access-controlled content of any third party, including accounts, inboxes, workspaces, or paywalled areas that belong to someone other than us. The Service captures public AI surfaces using our ownfleet accounts only; you may not use it to impersonate a user, harvest another person’s account, or circumvent an authentication or access control that is not ours.
• Attempt to defeat quotas, rate limits, metering, or authentication; probe or load-test the Service without our prior written consent; or interfere with its integrity or performance.
• Use the Service to build or train a competing capture service by systematically extracting our Envelope structure, artifacts, or infrastructure behavior.
• Use the Service in violation of any law, third-party right, or the acceptable-use or terms-of-service policies of the surfaces being captured, or to infringe intellectual property, defame, harass, or distribute malware.
• Resell or redistribute raw Service output in a manner that misrepresents its source, or present captured AI outputs as your own editorial statements or as ours.

We may suspend or throttle access, with or without notice, to protect the Service, other customers, third parties, or to comply with law.

5. Ownership of captured content

Captured AI outputs and the source pages they reference reflect content that belongs to the AI surfaces, publishers, and rightsholders that produced it. We do not claim ownership of that underlying content, and neither do you. The Service provides captures as a factual record of what a surface displayed at a point in time, not a license to the captured material.

You are responsible for ensuring that your use of captured content (including any onward publication, republication, or analysis) is lawful and consistent with the rights of the underlying rightsholders. Captured outputs may be inaccurate, biased, or incomplete because the underlying surfaces are; we present them as observed, and we do not endorse or verify their substance.

6. Our intellectual property; your data

We own the Service, including the API, the Envelope schema, the documentation, and our software and infrastructure. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service and its output for your internal business purposes and for lawful onward use consistent with Section 5.

As between you and us, you own the queries you submit and the outputs returned to you. You grant us the right to process them to operate, secure, meter, support, and improve the Service, and to retain artifacts as described in our Privacy Policy.

7. Aggregated indexes and derived datasets

Response content returned by the Service, engine answers and their citations, captured through API requests, may be used by us to build aggregated, anonymized indexes and derived datasets, including rankings that we make publicly available. We do not include your identity, account information, or anything else that could tie a specific capture back to you or your organization in these datasets. We may also process the text of the prompts you submit for topic classification, to determine what a capture is about, as part of building these datasets. Captures tied to a logged-in persona, and captures whose content appears to contain personal data, are excluded from this use; we retain such captures only briefly rather than durably.

8. Third-party services

The Service relies on third-party providers (for example, cloud and storage infrastructure, a managed browser network, and model-API routing) described in our Privacy Policy. Their availability and behavior are outside our control and may affect the Service.

9. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that captures are accurate, complete, uninterrupted, or error-free, or that any surface will be reachable. Captured AI outputs are not professional, legal, financial, or other advice.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amounts you paid us for the Service in the twelve months before the event giving rise to the claim, or USD 100.

11. Indemnification

You will defend, indemnify, and hold us harmless from claims, losses, and expenses arising out of your use of the Service, your content or queries, your onward use of captured content, or your breach of these Terms or of applicable law.

12. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required for security or legal reasons, or on notice for convenience. On termination, your right to use the Service ends; sections that by their nature should survive (including Sections 5, 6, 9, 10, 11, and 13) survive.

13. Changes, governing law, and contact

We may update these Terms. If we make material changes, we will take reasonable steps to notify you (for example, by email or an in-product notice) before they take effect. Continued use after the effective date of an update constitutes acceptance. The governing law and venue are those of the jurisdiction in which our operating entity (named above) is established, unless a mandatory law of your residence provides otherwise.
